The minimum list of services is established in the health insurance system for insured foreign citizens temporarily staying in the Russian Federation:

- medical care provided by ambulance stations (departments, points);

- medical care in outpatient and inpatient medical institutions in case of a sudden health disorder and accidents in the amount necessary to eliminate the threat to the patient's life and (or) relieve acute pain;

- transportation by medical transport or other means of transport, including medical escort (medical team, doctor, nurse), from the place of illness (incident) to a medical institution;

- posthumous repatriation (transportation) of the remains.

Situation:

Can citizens of foreign countries who do not have a temporary residence permit (or a residence permit in Russia) and a compulsory medical insurance policy and who arrived in Russia as tourists be vaccinated against COVID-19?

Answer

Foreign citizens enjoy rights in Russia and bear obligations on an equal basis with citizens of the Russian Federation; exceptions to this rule must be expressly provided for by federal law (Article 4 of Federal Law No. 115-FZ of July 25, 2002 "On the Legal Status of Foreign Citizens in the Russian Federation"). Directly the right to provide medical care in a guaranteed amount also belongs to foreign citizens (other may be provided for by international treaties of the Russian Federation). BECAUSE only emergency assistance can be provided free of charge, foreign tourists, as persons who do not have a temporary residence permit and a residence permit in Russia, as well as a compulsory medical insurance policy, do not have legal grounds for vaccination. In accordance with Part 2 of Art. 19 of Law N 323-FZ, everyone has the right to receive paid medical services and other services, including in accordance with a voluntary medical insurance contract. Specific conditions for VHI, incl. types of medical and other services provided under VMIP, including to foreign citizens, the forms and conditions for their provision are determined by the insurance policy in accordance with the insurance programs applied by the insurer, chosen by the insured when concluding the insurance contract.Accordingly, the obligations of a medical organization for vaccination under VMIP are determined by its contract with the insurance company. When providing medical care under VMIP, it is necessary to be guided by the Rules for the provision of paid medical services by medical organizations, approved by Decree of the Government of the Russian Federation of October 4, 2012 N 1006.

What assistance is mandatory (does not depend on the presence of policies), regardless of the age of the applicant, and what assistance is provided only on a paid basis or under a voluntary medical insurance policy? Is it legal to refuse foreign citizens (students, guest workers, children and the elderly) in case of the absence of a policy? If such persons received emergency assistance, then who pays for it?

Answer

Everyone has the right to health care and medical care (Part 1, Article 41 of the Constitution of the Russian Federation). PERSONS WITH CMIP (compulsory medical insurance policy) have the right to receive medical care in a guaranteed amount, provided free of charge in accordance with the program of state guarantees of free provision of medical care to citizens. The policy may NOT be presented in case of a medical emergency. Specific conditions for VMIP (voluntary medical insurance policy), incl. types of medical and other services provided under VMIP, including to foreign citizens, the forms and conditions for their provision are determined by the insurance policy in accordance with the insurance programs applied by the insurer, chosen by the insured when concluding the insurance contract. Accordingly, the duties of a medical organization for vaccination within the framework of VMIP are determined by its contract with the insurance company. Thus, emergency assistance is provided to absolutely everyone. Planned medical care is provided on a paid basis.

Foreign citizens can register in the antenatal clinic on a paid basis, with the exception of those who are entitled to compulsory health insurance in accordance with the Federal Law "On Compulsory Medical Insurance in the Russian Federation". In the event of an emergency with sudden acute conditions (a threat to human life and health), emergency medical care is needed. In this case, it is provided free of charge, regardless of the availability of a policy, citizenship until the exit from a state that threatens health.
